Hexahydrocannabinol (HHC) is a hot legal topic in the United States. In red states especially, the issue is becoming more heated by the day. A couple of years ago—and it was just a couple of years ago, as of this writing—there was a very loose legal status for hexahydrocannabinol in many states in America, and it was largely possible to at least find HHC products in jurisdictions allowing their sale.

Today, that’s no longer the case—and for many people, it’s certainly a case of ‘better the devil you know’. HHC is now strictly controlled—and in many places, strictly prohibited. Although HHC was legal for a time in Florida, this might no longer be the case following recent events.

So what is the current legal status of the cannabinoid HHC in the United States? What is the legal status of hexahydrocannabinol in Florida?

Key Takeaways

  • HHC is likely legal at a federal level in the United States, thanks to the 2018 Farm Bill, which allows any cannabinoid product derived from hemp with less than 0.3% Delta-9 THC by dry weight.
  • However, recent legislative changes in Florida suggest that HHC is no longer legal in the state. The new laws classify HHC as a synthetically derived cannabinoid, making it likely illegal.
  • Florida introduced new bills (House Bill 1475 and Senate Bill 1676) that have significantly altered the legal landscape for cannabinoids in the state.
  • Though aligned with the federal Farm Bill, these laws have added restrictions, particularly on synthetically derived cannabinoids, which would include HHC. Accordingly, HHC, being synthetically derived, is likely illegal in Florida now.
  • As a result of these new laws, HHC is most likely illegal in Florida, affecting its availability for purchase or possession within the state.

At the time of writing, yes it is. HHC is legal to purchase & use in Florida. Of course, you don’t want to push your luck. So make sure you only buy HHC from an above board supplier who guarantees the cannabinoid content at less than 0.3% THC. The best HHC brands formulate their products using US-grown hemp, and third-party laboratory testing ensures that what’s in the product is what the label says is in the product.

Although HHC is legal, it’s very potent, so do not operate heavy machinery or drive while under the influence. Driving while high is illegal, too, and could make law enforcement officials charge you with a DUI.

There was also a chance you asked, Will HHC show up on a drug test? Again, no drug test looks for HHC, per se, but a full-spectrum product will likely have minute amounts of actual THC in it, and that THC can appear on a drug test. So if you have a drug test coming up, it is best to avoid the HHC.

HHC and the Federal Law

According to federal law, specifically the 2018 Farm Bill as passed under the Donald Trump administration, any cannabinoid product is considered legal as long as it is made from hemp and does not have Delta-9 THC levels exceeding a certain amount.

To be specific, to be classified as hemp, cannabis must have less than 0.3% Delta-9 THC content by dry weight. As such, hemp products, whether smokable or edible, must contain less than 0.3% Delta-9 THC to be legal.

Florida’s Hemp Laws

Florida has fairly relaxed hemp laws. Mainly, Florida laws comply with the 2018 federal Farm Bill, which legalized lots of different cannabinoids.

However, there have been some changes made recently. Two new bills, i.e., House Bill 1475 and Senate Bill 1676, also known simply as “the bills,” now define the hemp landscape in Florida.

These new bills have made a host of changes to Florida’s hemp laws, including defining synthetic cannabis extracts. These laws assert that hemp is legal, but there are restrictions and caveats.

Here is the definition of hemp in Florida:

the plant Cannabis sativa L. and any part of that plant, including the seeds thereof, and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers thereof, whether growing or not, that has a total delta 9-tetrahydrocannabinol concentration that does not exceed 0.3 percent on a dry-weight basis, with the exception of hemp extract, which may not exceed 0.3 percent total delta-9 tetrahydrocannabinol on a wet-weight basis. The term does not include synthetically derived cannabinoids.

As you can tell, there is an important section included there about synthetically derived cannabinoids. Under these new laws, synthetically derived cannabinoids are defined as:

Any cannabinoid created by reacting a cannabis- or non-cannabis-derived extract with solvent or acid to increase the concentration of a present cannabinoid or to create a new cannabinoid not originally found in the extract.

Therefore, according to this new definition of synthetically derived cannabinoids, HHC would most likely be considered synthetically derived and would, therefore, be illegal under this new law.

HHC is now most likely illegal in Florida and is no longer available for purchase or possession.

Technically speaking, cannabinoids made from hemp with less than 0.3% Delta-9 THC on a dry weight basis are considered legal. However, this does not include synthetically derived cannabinoids like HHC.

Is HHC a Controlled Substance in Florida?

According to the new laws, it is likely that HHC is now considered a controlled substance in Florida, and therefore its possession is also not permitted.
