The INN (International Nonproprietary Name) for Delta-9 THC, whether of natural or synthetic origin, is dronabinol. THC produces its effects by binding to our endocannabinoid system's CB1 and CB2 receptors.

Delta 8 vs Delta-9 THC

Like Delta-9, Delta-8 is one of the isomers of THC. In the same way, Delta-8 also can generate psychoactive effects with the difference being that the effects of Delta-8 are less intense than those induced by Delta-9 THC.

Currently, THC-rich cannabis is legal in many states, both medicinally and recreationally. On the other hand, hemp is federally legal in all 50 states, according to the 2018 Farm Bill.

However, the state laws of some states may differ slightly from the federal laws in some cases. This is why some states seem more permissive regarding Delta-9 than others, and for this very reason, it is essential to discuss each state's Delta-9 THC legality index.

Is Delta-9 THC Legal in Texas?

Following the 2018 Farm Bill signing, Texas sided with the federal government by passing Texas House Bill 1325, signed by Governor Greg Abbott in June 2019. According to this bill, all cannabinoids, isomers, extracts, and hemp derivatives are legal.

Therefore, there is no established legal limit for Delta-8 THC and CBD, but there is for Delta-9 THC derived from hemp. Hemp-derived products with a Delta 9 content of 0.3% or less on a dry weight basis are legal at both the federal and state levels in Texas.

Is Delta 9 THC Legal in North Carolina?

North Carolina does not have a legal limit in place for CBD and Delta-8 THC, but there is a limit for the concentration of Delta-9 in cannabis and hemp-derived products. In fact, North Carolina remains one of the states where weed is still not legal.

Nonetheless, under federal law, hemp is legal at both the federal and state levels. Therefore, it is possible to find some products containing hemp-derived Delta-9 on the internet.

Is Delta 9 THC Legal in Florida?

State agricultural laws in Florida are aligned with federal laws. In this sense, cannabis, cataloged explicitly as hemp, is legal. Similarly, so are hemp-derived products such as CBD, Delta-8, Delta-10, and products with an acceptable Delta-9 hemp-derived THC index under the 2018 federal Farm Bill and Florida´s SB 1020 2019 Farm Bill.

Is Delta 9 THC Legal in Georgia?

In 2019, Governor Brian Kemp signed House Bill 213, which makes hemp and all its derivatives, extracts, cannabinoids, and isomers legal, including hemp-derived Delta-9.

However, Delta-9 THC is not entirely legal in Georgia like CBD or Delta-8 are. While these last two mentioned cannabinoids do not have a set limit, any product containing Delta-9 THC must contain 0.3% or less to be fully legal under state and federal law.

Is Delta 9 THC Legal in New York?

To put it short, yes, Delta-9 is legal in New York. In fact, New York became the 15th state to legalize the recreational use of marijuana following Senate Bill S854A.

Nonetheless, New York presents a curious case. While products containing Delta-8 THC are not legal for sale, products containing hemp-derived Delta-9 THC, marked as “hemp delta-9” or “CBD+THC,” are legal and available for online purchase in concentrations between 2mg to 25mg of THC per serving.

Is Delta 9 THC Legal in Illinois?

Yes, delta-9 is legal in Illinois but with specific regulations. Illinois state law is aligned with federal law in that hemp, and all derivative products, including cannabinoids, isomers, and hemp extracts, have been legal since the signing of the 2018 Farm Act.

In addition, Illinois legalized and recreational use of THC-rich cannabis as of June 2020. This means that in Illinois, you can buy cannabis products that contain Delta-9 THC. But, cannabis products contain Delta.9 THC must follow state laws and regulations and be approved by the FDA.

Is Delta-9 THC Legal in Alabama?

As long as it's Delta-9 derived from hemp, yes, Delta-9 is legal in Alabama. On the contrary, if we talk about Delta-9 derived from marijuana, any product that contains more than 0.3% of Delta-9 THC is considered "weed" and therefore is illegal, or, failing that, will require a license for medical cannabis.

Is Delta-9 THC Legal in Alaska?

Alaska separated hemp from marijuana in Senate Bill 27, legalized hemp cultivation, and banned hemp products and their derivatives such as CBD, Delta-8, and hemp-derived Delta-9 THC. However, there is a legal limit set for Delta-9 THC which states that any cannabis-derived product must contain 0.3% or less of Delta-9 THC to be legal.

Is Delta-9 THC Legal in Arizona?

Both hemp and its derived products, cannabinoids, isomers, and extracts from it, have been legal in Arizona since the signing of the Farm Bill in 2018. Shortly thereafter, Arizona also legalized the recreational use of THC-rich cannabis for those over 21 years of age upon Senate Bill 1098 going into effect in 2020. This means that it is legal to buy and use products containing Delta-9 THC as long as they are under state regulations.

Is Delta-9 THC Legal in Arkansas?

State laws in Arkansas regarding hemp and its byproducts, such as CBD, Delta-8, and Delta-9, remain relatively aligned with federal laws. Thus, Delta-9 THC is only legal in Arkansas for certified medical marijuana patients. Following the same regulations and in accordance with the 2018 Farm Bill, all products containing 0.3% Delta-9 THC or less are completely legal for use and sale within Arkansas.

Is Delta-9 THC Legal in California?

We could say yes, Delta-9 THC and products containing this isomer are legal in California but with certain regulations. After the signing of the 2018 Farm Bill, the United States federal government determined that hemp and marijuana are different things and removed hemp from the Controlled Substances Act or CSA.

This means that hemp and its derivative products, including hemp-derived Delta-9 THC, are federally legal at the federal level. Therefore, cannabis products containing 0.3% Delta-9 THC or less are legal in California.

Is Delta-9 THC Legal in Colorado?

The answer is yes if you're in Colorado and wondering if Delta-9 is legal. In fact, Colorado is one of the states where the recreational use of cannabis rich in Delta-9 THC.

But, it was not until 2019, when Governor Ned Lamont signed Senate Bill 893, that hemp, its derived cannabinoids such as CBD, Delta-8, Delta-9 THC derived from hemp, and hemp cultivation ceased to be illegal at the state level.

Despite this slight delay by the Connecticut government to align with federal laws, in 2021, Connecticut became one of the forerunner states in legalizing cannabis recreationally after the signing of Senate Bill 1201 and being the 19th state to take this position regarding cannabis rich in Delta 9.

Is Delta-9 THC Legal in Delaware?

We could say yes, hemp-derived Delta-9 is legal in Delaware with certain regulations since 2018 when the 2018 Farm Bill came into force and under title 3-Chapter 28, which federally legalizes hemp and its commercialization. Since then, Delaware has legalized producing hemp, its derived cannabinoids, isomers, extracts, and other byproducts.

Hemp products in Delaware must contain 0.3% Delta-9 THC or less on a dry weight basis. Nonetheless, suppose the hemp product contains more than this indicated concentration of Delta-9. In that case, it may fall under the category of marijuana and will be illegal at both the state and federal levels.

Is Delta-9 THC Legal in Florida?

The 2018 Farm Bill federally legalized hemp and its derived cannabinoids such as CBD, Delta-8, and Delta-9 THC. According to the Florida Hemp Bill SB 1020 that went into effect in 2019, hemp products containing Delta-9 THC are legal as long as the hemp product contains 0.3% of this last mentioned isomer.

Is Delta-9 THC Legal in Hawaii?

Since the signing of the Farm Bill in 2018, hemp, derivative products and compounds, and its industrial production are legal at the federal level and therefore are also permitted in Hawaii. But this leaves the question open for many people, is Delta-9 also legal in the Aloha state?

The simplest answer is yes. Many people think that Delta-9 is straight-up "weed." But, the truth is that for a product to be classified as marijuana, it must contain more than the content indicated in House Bill 2689 of the state of Hawaii, which indicates that, for a cannabis product or extract to be illegal, it must contain more of 0.3% concentration index of Delta-9 THC.

Is Delta 9 THC Legal in Idaho?

Idaho is one of the states that maintains a strict position regarding the use of cannabis with Delta-9 THC, both recreationally and medically. In fact, in Idaho, it is allowed to market and use hemp products and their derivatives only if they contain zero Delta-9 THC.

However, after signing the Farm Bill in December 2018, Idaho followed suit and also approved hemp and its derivatives, including Delta-9 THC, as long as its concentration is less than 0.3%.

Is Delta-9 THC Legal in Indiana?

Concerning Delta-9, Indiana follows federal guidelines. This means that, in some way, hemp-derived Delta-9 and products containing this cannabinoid are partially legal as long as they follow the criteria of state law.

This criterion establishes that any hemp product or any of its derivatives must contain 0.3% Delta-9 or less so that it does not fall into the category of "marijuana" and be illegal. Nevertheless, any cannabis or hemp product that complies with Indiana Code 15-15-13 is entirely legal for use and consumption within Indiana.

Is Delta-9 THC Legal in Iowa?

We could say yes, but with regulations. In Iowa, there is some tolerance for Delta-9, which aligns with the federal laws approved in the 2018 Farm Bill at the federal level.

Any cannabis or hemp product containing 0.3% Delta-9 THC in Iowa is legal and suitable for possession, use, or sale within Iowa. On the other hand, Delta-8 THC, even if derived from hemp, is illegal in this state, even though hemp products are legal under federal law.

Is Delta-9 THC Legal in Kansas?

Since the United States federal government passed the 2018 Farm Bill, Kansas has also aligned itself with these laws concerning cannabis, hemp, and their cannabinoids, isomers, and derived extracts. Since then, CBD, Delta-8, and all hemp products have been legal in Kansas.

Regarding Delta-9 THC, the regulations are the same as those dictated by federal law. This means that Delta-9 THC is legal up to a concentration of 0.3% in any cannabis product.

Is Delta-9 THC Legal in Kentucky?

Kentucky's situation concerning Delta-9 is basically the same as that of all states aligned with federal law. This means that hemp products are legal as long as they follow state and federal regulations. You must be at least 21 years of age in Kentucky to purchase hemp products and derivatives. There is no limit for CBD and Delta-8, Delta-10 THC, or HHC.

Nevertheless, if there is an established limit for Delta-9 THC that dictates that any product that exceeds a 0.3% concentration of Delta-9 can fall into the category of “weed” and therefore be illegal.

Is Delta-9 THC Legal in Louisiana?

The Louisiana government took a while to catch up with the federal government after the 2018 Farm Bill went into effect. Since 2018, the federal government separated hemp and its derivatives from THC-rich cannabis, or marijuana, and removed it from the Controlled Substances Act, or CSA.

But, it wasn't until 2019 that Governor John Bel Edwards signed the 491 House Bill, which legally separated hemp from marijuana and legalized hemp, its production, cannabinoids, isomers, extracts, and derivative products in the state of Louisiana.

Is Delta-9 THC Legal in Maine?

Short answer, yes. But, Maine also took some time to fall in line with federal laws and it was not until 2019 thanks to LD11 that hemp and its derivatives became legal in this state, including Delta-9.

Actually, Maine was the 4th state to legalize the recreational use of cannabis in 2016 but there was some delay in all the relevant regulations in this regard, and it was not until October 9, 2020, that legal cannabis sales really started.

Is Delta-9 THC Legal in Maryland?

We can say that yes, the Delta-9 is legal in Maryland but with certain regulations. As in the rest of the entire United States, hemp, its cannabinoids, and derived products have been legal since December 2018, when President Donald Trump signed the Farm Bill that legally separated hemp from marijuana. There is no set limit for CBD, Delta-8, Delta-10, and other hemp derivatives in Maryland.

But, in the case of Delta-9, the allowed content of this cannabinoid is 0.3%. Any cannabis product with a higher content of Delta-9 than that already indicated will fall into the category of "weed" and requires a medical license to get it legally.

Is Delta-9 THC Legal in Massachusetts?

In Massachusetts, hemp has been legal since the signing of the Farm Bill in 2018. Cannabis rich in Delta-9 is legal both medicinally and recreationally. Therefore, there is no set limit to the amount of Delta-9 THC that a cannabis or hemp product must contain for it to be legal.

Is Delta-9 THC Legal in Michigan?

Yes, Delta-9 is legal in Michigan, but under certain laws and regulations. Michigan was one of the pioneer states in legalizing the use and consumption of hemp since the signing of the hemp bill in 2014. This was followed by the decree at the federal level when President Donald Trump signed the Farm Bill of 2018.

All products derived from hemp, including its cannabinoids such as CBD, Delta-8, and Delta-10, are legal without an established legal limit. However, there is a limit to Delta-9 and products that contain it. Any cannabis product considered legal in Michigan must contain 0.3% Delta-9 content. Otherwise, it would be marked "weed" and illegal in Michigan.

Is Delta-9 THC Legal in Minnesota?

We could say that, yes, Delta-9 is legal in Minnesota but as long as it follows certain regulations. Minnesota also followed the 2018 Farm Bill regarding hemp, its natural compounds, and byproducts.

Nevertheless, it took Minnesota a little longer to follow through. It wasn't until 2019 when Governor Mark Dayton signed the Industrial Hemp Development Act, that state law separated hemp from THC-rich cannabis. Since then, hemp cultivation and its products have been legal in Minnesota.

There is no limit in this state for some cannabinoids such as CBD, Delta-8, or Delta-10 THC. But, there is a limit set for Delta-9 THC. State laws follow the 2018 Farm Bill, which indicates that any hemp or cannabis product containing 0.3% or less of Delta-9 THC content is entirely legal and available for sale, both in dispensaries and online.

Is Delta-9 THC Legal in Mississippi?

As in other US states, Delta-9 is legal in Mississippi, according to the Farm Bill that the federal government signed in 2018. Since then, hemp has been legal in Mississippi, and in 2019, Governor Tate Reeves reconfirmed the legality of hemp cultivation, the manufacture of derivative products, its cannabinoids, and isomers by signing Senate Bill 2725, also known as the Mississippi Hemp Cultivation Act.

The point is that, while for some hemp-derived cannabinoids such as CBD or Delta-8 THC, there is no established legal limit, the content of Delta-9 in any cannabis product cannot exceed 0.3% concentration, or it will be seen as "weed," and marked as illegal.

Is Delta-9 THC Legal in Missouri?

If you are wondering if Delta-9 is legal in Missouri, the shortest answer we can give you is yes, Delta-9 is legal in Missouri, but as long as it follows the regulations set forth by the state government.

Cannabis products containing a 0.3% concentration of Delta-9 THC have been legal in Missouri since the federal government signed the Farm Bill in 2018. Cannabis products with a higher concentration of Delta-9 than the aforementioned are also permitted but for medicinal purposes and only for patients with a qualifying condition.

Is Delta-9 THC Legal in Montana?

Delta-9 has been legal in Nebraska since 2018, and the cultivation of hemp and the manufacture of products derived from it are legal at the federal level. But the truth is that at the state level, hemp-derived products and cannabinoids, including Delta-9, are legal with some regulations since Governor Pete Ricketts signed LB657 in 2019. Consequently, products containing Delta-9 are legal as long as they carry 0.3% or less of this isomer.

Is Delta-9 THC Legal in Nevada?

Yes, in fact, Nevada is one of the forerunner states in terms of the legalization of Delta-9. This is because cannabis rich in Delta-9 THC has been legal in Nevada for recreational use since 2017.

On the other hand, hemp products, derived cannabinoids, isomers, and extracts only became fully legal in 2019 when Nevada passed Chapter 557. The case of Nevada is like that of the other states that legalized the recreational use of “weed.” Although Delta-9 is legal in Nevada, cannabis products with a concentration of Delta-9 greater than 0.3% are still illegal at the federal level.

Is Delta-9 THC Legal in New Hampshire?

Delta-9 is legal in New Hampshire in a similar way that it is federally legal. The state of New Hampshire passed House Bill 459-FN, which decrees that hemp products, their cultivation, and their derived cannabinoids, including Delta-9, are legal in the state.

Similar to federal law, New Hampshire State Farm Law dictates that any cannabis product containing 0.3% Delta-9 THC or less is allowed within the state.

Is Delta-9 THC Legal in New Jersey?

Is Delta-9 THC Legal in New Mexico?

As of 2018, all cannabinoids, isomers, extracts, and hemp derivatives are federally legal in New Mexico, thanks to the Farm Bill that went into effect that year. So yes, Delta-9 has been legal in New Mexico ever since but with certain regulations.

Delta-9 and the cannabis known as “marijuana” is legal in New Mexico for medical patients with a qualifying condition. But, for ordinary people without any condition warrants, Delta-9 is permitted if its concentration is 0.3% or less.

Is Delta-9 THC Legal in North Dakota?

Yes, Delta-9 is legal in North Dakota as long as its content in any cannabis product is following the regulations imposed by the 2018 Farm Bill issued by the federal government. This means that Delta-9 THC is legal within the state but under certain regulations.

As of 2018, hemp, CBD, Delta-8, and Delta-10 are legal within the state, and there is no limit to the content of these cannabinoids.

However, there is a limit to Delta-9. Federal law indicates that any cannabis product containing 0.3% Delta-9 THC content in North Dakota is legal to possess, sell, and use. On the other hand, if the Delta-9 THC content is greater than 0.3%, the cannabis product will be considered “weed” and therefore illegal.

Is Delta-9 THC Legal in Ohio?

Delta-9 has been legal in Ohio and at the federal level since 2018 when the Department of Agriculture signed into law the Farm Bill signed by President Trump. When this new farm bill goes into effect, any cannabis product with a Delta-9 THC content of up to 0.3% or less is legal at the federal level and in Ohio.

Is Delta-9 THC Legal in Oklahoma?

To put it short, yes, Delta-9 is legal in Oklahoma. Since the Farm Bill was signed into law in 2018, hemp, its cultivation, industrial production, and its cannabinoids, isomers, extracts, and derived byproducts, including Delta-9, are federally legal in the Sooner state.

While there is no legal limit for some cannabinoids like CBD, Delta-8, Delta-10, and HHC, there is one for Delta-9. Federal law says that for a cannabis product to be considered legal within Oklahoma and at the federal level, it must contain 0.3% Delta-9 THC or less.

Is Delta-9 THC Legal in Oregon?

Delta-9 THC and hemp products and their derivatives have been legal in Oregon since 2018 when the Farm Bill signed by Donald Trump came into effect. In fact, in Oregon, the recreational use of THC-rich cannabis, or marijuana, has been legal since 2014.

Nonetheless, there are some restrictions and regulations regarding the amount of Delta-9-rich cannabis products at the time you can buy. Cannabis products containing more than 0.3% Delta-9 content must also comply with regulations imposed by the state of Oregon to qualify as legal within the state.

Is Delta-9 THC Legal in Pennsylvania?

To put it succinctly, we can say that yes, Delta-9 is legal in the state of Pennsylvania but under the same federal regulations as in the rest of the states aligned with the 2018 Farm Bill. This means that Delta-9 9 is legal up to concentrations of 0.3%.

Additionally, cannabis products containing more than 0.3% Delta-9 are permitted but only for medical purposes, while recreational use of cannabis rich in Delta-9 THC is still illegal.

Is Delta-9 THC Legal in Rhode Island?

Delta-9 is legal in Rhode Island and at the federal level, thanks to the 2018 Farm Bill signed by President Trump. But however, there is a legal limit to the concentration of Delta-9 allowed in cannabis products, up to 0.3%. On the other hand, there is no limit to other hemp-derived cannabinoids such as Delta-8, Delta-10, HHC, and CBD.

Is Delta-9 THC Legal in South Carolina?

South Carolina is also part of the states that said yes to Delta-9 THC. The signing of the 2018 Farm Bill brought with it an enormous growth in the cannabis industry nationwide, and South Carolina became a part of this growth by passing the South Carolina House Bill 3449.

This South Carolina Bill declares all cannabinoids legal and derivatives of hemp and cannabis, including Delta-9. However, Delta-9 is regulated in the same manner as federal law, which imposes a limit of up to 0.3% Delta-9 THC content for any cannabis product.

Is Delta-9 THC Legal in South Dakota?

As of this writing and after the South Dakota Senate signed House Bill 1191 into law, Delta-9 THC is legal in the state up to a concentration of 0.3%. Similarly, hemp, in general, its production, and derived cannabinoids such as CBD, Delta-8, and Delta-10 are also legal, and unlike Delta-9, they do not have a defined federal concentration limit.

Is Delta-9 THC Legal in Tennessee?

In short, yes, Delta-9 is legal in Tennessee according to federal law and SB357, which states that this cannabinoid is legal in cannabis products as long as its concentration is 0.3% or less. This SB357 of the state of Tennessee was given after the famous Farm Bill of 2018 was signed into law by the federal government of the United States.

Is Delta-9 THC Legal in Utah?

Delta-9 is legal in Utah but under specific regulations. Before 2018, even hemp extracts were limited to exclusively medicinal uses and required a license or medical letter to obtain them legally.
