If you’re still not sure whether or not the Delta 10 is legal in the state of Florida, you’re not alone.

Between the constant evolution of hemp-derived cannabinoids and new THC isomers, the recent passage of federal and state legislation, and even the fact that some local cannabis laws differ between cities and even counties – it can be tricky to differentiate which type of cannabinoid is legal and which one you should pass on when it comes to cannabinoid varietals!

Key Takeaways

  • Simply put, the Delta 10 is federally legal.
  • Local Florida laws are aligned with federal laws, so Delta 10 and Delta 8 are legal throughout the state.
  • Florida cannabis regulations do not impose a possession limit on Delta 10 or other hemp extracts and derivatives within the state.

Delta 10 and Federal Law

Federal cannabis laws are relatively clear on what’s allowed and what’s not. With the passage of the 2018 Farm Bill, the federal government legalised cannabis plants containing less than 0.3 per cent of Delta-9 (primarily) THC by dry are defined as hemp cannabis.

Raw plants, substances or products derived from hemp, including Delta 10, are legal to manufacture, distribute and sell in the US.Delta 10 itself is federally legal. But some states strictly regulate hemp-derived psychoactive cannabinoids like Delta 10 and Delta 8.Delta 10 is legal in 41 states.

But make sure that your local laws aren’t against Delta 10 or other psychoactive hemp-derived cannabinoids.

Florida's Delta 10 Laws

While some states have developed laws to ban Delta 8 and other hemp-derived psychoactive cannabinoids, Florida has taken a completely different stance. In fact, local Florida laws are aligned with federal laws.

For instance, Florida's SB 1698 effective January 2024, legalizes hemp. It doesn't stop there; it also defines concepts like "total delta-9-tetrahydrocannabinol concentration" and outlines the conditions for growing, processing, and distributing hemp products.

SB 1698 also reduces the permissible THC content in hemp products. It sets "THC limits in hemp products to no more than 5mg per serving and 50mg per container."

Of course, only persons aged 21 and above are allowed to purchase and own hemp products.

Is Delta 10 a Controlled Substance in Florida?

Florida statutes list Hemp as an agricultural commodity. In Florida, hemp-derived products are not controlled substances therefore Delta 10 clearly falls into the category of hemp-derived cannabinoids.

Florida SB 1020; all extracts, cannabinoids, and isomers derived from hemp that has a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis, including all isomers, acids, salts, and salts of isomers, whether growing or not and whether cultivated or wild, as well as any synthetic cannabinoids that are isomers of cannabinoids and/or tetrahydrocannabinols that fall under that definition are not controlled substances and are legal for use.

Delta 10 Possession Limits in Florida

Florida cannabis regulations do not impose a possession limit on Delta 10 and other hemp extracts and derivatives.

Delta-10 has been legal in Florida since the state passed SB 1020. Therefore, Floridians may use, purchase, or have Delta 10 products as long as they do not exceed the 0.3% THC limit. Delta-10 products are permitted in Florida without any restrictions as to product type, concentration, delivery method, or possession limits.

While at it, why don't you find out if HHC is legal in Florida?

Hemp-derived psychoactive cannabinoids are also controversial, and also the subject of laws in many States. Some States allow them, but other States have taken a hardline stand against cannabinoid isomers such as Delta 8, Delta 10, HHC, and other psychoactive compounds derived from legal hemp.Fortunately, the state government of Florida is in sync with the federal government, and permits the manufacture, distribution, and sale of hemp cannabinoids (not unlike the federal government does).

This bodes well for cannabis users, and by extension Delta 10 products, which become available with no fuss, and without the fear of penal consequences if they get it legally. If you’re in Florida and want Delta 10 products, then congratulations: you can definitely get them at a local dispensary or, if you prefer, order them on your favourite brand’s/distributor’s website
